Welcome to PixWave AI. By accessing or using our AI image and video generation service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and PixWave AI. Your use of the Service signifies your acceptance of these Terms and our Privacy Policy.

PixWave AI is an AI-powered platform that enables users to generate images, videos, greeting cards, and story videos using artificial intelligence technology. Our Service includes:

• AI-powered image generation from text prompts
• AI-powered video generation (30-second videos)
• Personalized greeting card creation
• Multi-scene story video production
• Content editing and customization tools

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.

To access certain features of PixWave AI, you must create an account using Google Sign-In. By creating an account, you agree to:

• Provide accurate and complete information during registration
• Maintain the security of your Google account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Ensure you are at least 13 years of age (or the minimum age in your jurisdiction)

We use Google Sign-In for authentication purposes. By signing in with Google, you also agree to Google's Terms of Service and Privacy Policy. You are responsible for maintaining the confidentiality of your Google account.

PixWave AI operates on a credits-based system. Credits are used to generate content on our platform.

Free Tier

• All users receive 20 free credits per month
• Free credits reset on the 1st day of each calendar month
• Unused free credits do not roll over to the next month
• No credit card required for the free tier

Pay-As-You-Go

• Credits are available at $0.05 per credit
• Minimum purchase: $5.00 (100 credits)
• Auto-recharge option available when balance falls below 10 credits
• Optional monthly spending cap can be configured

Credit Packs

• Starter Pack: $9 for 200 credits
• Pro Pack: $19 for 500 credits
• Power Pack: $49 for 1,500 credits
• Purchased credits never expire

Credit Usage

• Image generation: 1 credit per image
• Video generation (30 seconds): 10 credits per video
• Story video (3 scenes): 25 credits per video

Refund Policy

Important: Credits that have been used to generate content are non-refundable. Unused credits may be eligible for refund within 14 days of purchase at our sole discretion. To request a refund, contact support@pixwaveai.com.

You agree to use PixWave AI only for lawful purposes and in accordance with these Terms. You agree NOT to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Create content depicting minors in inappropriate, sexual, or violent contexts
• Generate content that promotes violence, terrorism, or hate speech
• Create deepfakes or misleading content intended to deceive or defraud
• Violate any intellectual property rights, including copyrights, trademarks, or patents
• Generate content that infringes upon someone else's likeness or privacy rights without consent
• Create spam, malware, or other malicious content
• Attempt to reverse engineer, decompile, or extract the underlying AI models
• Use the Service to compete with PixWave AI or create a similar service
• Abuse or exploit the Service in ways that harm our infrastructure or other users

Warning: Violation of this Acceptable Use Policy may result in immediate termination of your account without refund and may be reported to appropriate authorities.

Subject to your compliance with these Terms and payment of applicable fees:

• You own the images and videos generated using PixWave AI ("Generated Content")
• You are granted full commercial rights to use, reproduce, distribute, display, and create derivative works from your Generated Content
• You are solely responsible for your Generated Content and how you choose to use it
• PixWave AI retains no ownership rights to your Generated Content

License to PixWave AI

By using the Service, you grant PixWave AI a limited, non-exclusive, worldwide, royalty-free license to use your Generated Content for the following purposes:

• Operating, maintaining, and improving the Service
• Displaying examples in marketing materials (with your consent)
• Training and improving our AI models
• Complying with legal obligations

Your Responsibilities

While you own the Generated Content, you are responsible for:

• Ensuring your use complies with all applicable laws and regulations
• Obtaining necessary permissions if generating content based on copyrighted material
• Not representing AI-generated content as human-created where disclosure is required
• Complying with platform-specific rules when sharing Generated Content elsewhere

The PixWave AI Service, including its software, algorithms, user interface, design, logos, and all content not generated by users, is owned by PixWave AI and is protected by intellectual property laws.

Our Rights

• PixWave AI retains all rights, title, and interest in the Service
• Our trademarks, service marks, and logos may not be used without written permission
• The underlying AI models and technology remain our proprietary property
• You may not copy, modify, or create derivative works of the Service itself

Copyright Infringement

We respect intellectual property rights. If you believe content on PixWave AI infringes your copyright, please contact us at support@pixwaveai.com with:

• A description of the copyrighted work
• A description of where the infringing material is located
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement that the information is accurate and you are authorized to act
• Your physical or electronic signature

Your Rights

You may terminate your account at any time by contacting support@pixwaveai.com. Upon termination:

• Your access to the Service will be revoked
• Unused purchased credits may be refunded at our discretion
• Your Generated Content remains your property
• We may retain some data as required by law or for legitimate business purposes

Our Rights

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if:

• You breach these Terms of Service
• You violate the Acceptable Use Policy
• Your account is involved in fraudulent or illegal activity
• We are required to do so by law
• Continuing the Service creates a security risk or legal liability

Termination for violations will result in forfeiture of all credits without refund.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by law, PixWave AI disclaims all warranties, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Any warranties that the Service will be uninterrupted, secure, or error-free
• Any warranties regarding the accuracy, reliability, or quality of Generated Content
• Any warranties that Generated Content will not infringe third-party rights
• Any warranties regarding the results obtained from using the Service

AI-generated content may contain errors, biases, or unexpected results. You use the Service at your own risk and are solely responsible for evaluating the Generated Content before use.

Some jurisdictions do not allow the disclaimer of implied warranties, so some of the above disclaimers may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPPROMPT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

This includes, but is not limited to, damages or losses resulting from:

• Use or inability to use the Service
• Unauthorized access to or alteration of your content or data
• Statements or conduct of any third party on the Service
• Generated Content that is inaccurate, offensive, or infringes third-party rights
• Any errors, mistakes, or inaccuracies in the Service
• Personal injury or property damage resulting from your use of the Service
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service

In no event shall PixWave AI's total liability to you for all damages exceed the amount you paid to PixWave AI in the twelve (12) months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so some of the above limitations may not apply to you.

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you via email or through the Service
• Provide at least 30 days' notice for material changes

Your continued use of the Service after changes to the Terms constitutes acceptance of the modified Terms. If you do not agree with the modified Terms, you must stop using the Service and may terminate your account.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PixWave AI regarding the Service and supersede all prior agreements and understandings.
